Both are at fault. The concealed carry holder should have never exited the vehicle and on first contact with the officer, should have let him know he had a conceal carry permit and had a gun on him. The officer was over reacting and needs to be retrained.

  In my state and many others you are not REQUIRED (Did you get that? NOT Required to disclose you are carrying OR have a permit). In fact in My state we have CONSTITUTIONAL Carry. The officer is an asshole. Overreacting as most of them do. He should be fired. Threatening to shoot someone in the back is a felony threat and that man is allowed to use whatever force necessary to stop the threat.

  The laws on this question vary by state, and the other poster is correct. I’ve looked into this, and I believe in most states – when the cop pulls someone over, and then runs the license plate on his laptop – the name of the individual who is registered for that license plate number appears on his screen, and I think most states also have a notation beside the name of the individual that indicates whether or not they have a concealed carry permit. Personally, I have a problem with the idea that states are allowed to do this – but, the argument they use is that they claim it is for the safety of the officer. I consider that to be a crock of manure, since CCP holders are, by and large, the most law abiding citizens of any other demographic group – and had to pass a background check before being issued their permit to carry concealed. So, why should they be singled out for an extra notation like this? A cop who pulls over a car full of gang bangers, and runs the license plate number – is most likely not going to get a screen that has a notation on it that says: ‘Gang Banger, proceed with caution’, right? But, isn’t the personal safety of the officer more at risk in those situations than when he pulls over a law abiding citizen who is a CCP holder?
  
  At any rate, the point I am trying to make – is that if the cop runs the plate, and is shown the name and photo of who is supposed to be the registered owner of the vehicle (which may not be who is driving, since people do borrow or lend their cars to family or friends) – I would say that most states probably have a CCP holder box checked ‘yes’ alongside the registered owner’s name. So, the cop – if he is paying attention, already knows that the driver might be the CCP holder before he approaches the vehicle. At this point, in my home state, if the cop asks the driver if he is a CCP holder and is he or she presently carrying a weapon on their person or in the vehicle, then the CCP holder is required by law to answer truthfully. But, it there is no law that forces a citizen to volunteer that information without being asked.
  
  Some states, especially those infested with totalitarian, Communist control freak liberals, might have different laws to cover this issue.

This officer should be sued for assault, making a terrorist threat, unlawful arrest, and violation of civil rights. The amount awarded will be enough to ensure that he lives in poverty for the rest of his natural life. See how he likes the consequences of his actions. If you can’t do the time, don’t do the crime, Deputy.

Although, I feel for the gentleman and his wife we all know he would have shot the man in his back if he were a black man… and he would have gotten a vacation and possibly a promotion from it. In any profession, you would be penalize for not knowing the laws that govern your profession and/or fired. However, with police/TSA and the other gang of criminals running “law enforcement” you are require to be dumb to do your job. In all these videos popping up since the Patriot Act the police are the aggressors. Good luck Amercia you gonna need it because the drone strikes are next.

Watching this stirs anger, for sure. The driver shouldn’t have gotten out of the car, and the deputy was unrelenting. The guy was reaching for his insurance and registration when the gun showed. He didn’t show the gun on purpose. Plus, the permit holder DID tell the deputy that he had a permit. The deputy, afraid for his life (and can you blame him, really), did NOT listen. It’s the not belligerence of the deputy that is so frustrating.
